By accessing or using the website fiofoundation.org ("Website"), registering for any training programme, bootcamp, or online course offered by FIO Foundation, or by submitting any form on this Website or engaging FIO Foundation for any advisory, compliance, or audit service, you ("User", "You", "Participant", "Client") agree to be bound by these Terms of Use ("Terms").
If you do not agree to these Terms, please do not use this Website, register for any programme, or engage FIO Foundation for any service.
These Terms apply to all visitors, users, enquirers, bootcamp registrants, training participants, compliance support clients, advisory clients, and any person who accesses or uses any part of this Website or FIO Foundation's services.
1. About FIO Foundation
FIO Foundation ("Future Is Ours Foundation", "FIO", "We", "Us", "Our") is a not-for-profit organisation registered in Kerala, India, specialising in POSH Act (Prevention of Sexual Harassment at Workplace Act, 2013) training, compliance support, advisory services, Internal Committee formation, workplace safety education, and POSH audits.

2. Services Offered
FIO Foundation offers the following services through this Website and through direct engagement:
2.1 Training Programmes
- POSH Employee Awareness Training — Live sessions for all employees, conducted online or at physical venues across Kerala, in Malayalam and English
- POSH Internal Committee (IC) Training — Comprehensive training for IC members on complaint procedure, inquiry process, documentation, principles of natural justice, and annual reporting
- POSH Bootcamps — Intensive full-day or multi-day training events at physical venues across Kerala, with registration and payment facilitated through this Website
- POSH Certification Programme — A structured multi-module programme leading to a Certificate of Completion, for HR professionals, legal officers, social workers, and compliance practitioners
- Self-Paced Online Courses — Pre-recorded digital learning programmes on POSH Act topics (currently in development; additional product-specific terms will apply when launched)
2.2 Comprehensive POSH Compliance Support
End-to-end POSH compliance support for organisations, covering some or all of the following depending on agreed scope:
- Internal Committee (IC) Formation — constitution, nomination letters, office orders
- External IC Member Services under Section 4 of the POSH Act
- IC Meeting Support — agenda templates and minutes formats
- IC Training and Employee Awareness Training (as in 2.1)
- Annual Report Preparation under Sections 21 and 22 of the POSH Act
- POSH Policy Development — drafting, reviewing, or updating
- Portal Registrations — Kerala WCD POSH Portal and SHe-Box portal
- Notice Board Compliance under Section 19(b)
Scope, fees, and timelines are agreed in writing prior to commencement and are not listed on the Website.
2.3 POSH Advisory — Case Handling and Inquiry Support
Advisory guidance to organisations and Internal Committees on handling POSH complaints and conducting POSH inquiries, including complaint receipt, inquiry procedure, IC member roles, interim relief, timelines, documentation, and post-inquiry guidance.
Important Limitation: POSH Advisory is a compliance awareness and procedural guidance service. It is NOT legal representation, legal opinion, or legal advice. FIO Foundation does not act as advocate or legal counsel for any party. See Section 11.
Confidentiality: All information shared in the context of a POSH Advisory engagement is treated as strictly confidential and will not be disclosed to any third party except as required by law.
2.4 POSH Audit
POSH Compliance Audits assess current POSH Act compliance, typically covering IC composition, POSH Policy review, training records, annual report and portal compliance, notice board compliance, IC meeting records, and gap identification. The output is a written Gap Analysis Report and Remediation Roadmap.
Important Limitation: The POSH Audit is a compliance awareness and gap assessment, NOT a statutory audit, legal audit, or regulatory inspection. It does not constitute a legal certificate of compliance or guarantee of full compliance.
2.5 Delivery of Services
Programmes may be delivered by FIO Foundation's founder, by authorised partner trainers, or in collaboration with third-party co-hosts and venue partners. FIO Foundation remains responsible for overall quality and standards. See Section 12 for details.
3. Eligibility and Acceptance
By using this Website or engaging our services, you confirm that:
- You are at least 18 years of age
- You have legal capacity to enter into a binding agreement
- If contracting on behalf of an organisation, you have authority to bind it
- All information provided is accurate, complete, and current
- You will use the Website and services only for lawful purposes
FIO Foundation reserves the right to refuse service, cancel registrations, or terminate access at its sole discretion.
4. Registration and Booking
4.1 Bootcamp and Live Training Registration
- Booking is confirmed only upon successful payment through Razorpay
- Confirmation will be sent via email and/or WhatsApp
- Registrations are first-come, first-served based on payment
- You must provide accurate details at registration
4.2 Online Course Enrolment
- Enrolment is confirmed upon successful payment
- Access provided through a designated platform or link
- Access is for individual use only and may not be shared
- Specific terms for each course will be published with the listing
4.3 Compliance Support, Advisory, and Audit Engagements
- Initiated through enquiry via Website, email, or WhatsApp
- Scope, deliverables, timelines and fees confirmed in writing first
- Not booked or paid through the Website's online payment system
4.4 Participant Substitution for Live Events
- Substitute another individual subject to notification at least 48 hours before the event with substitute's name, designation and contact details
- Substitution is permitted at no additional charge
- Available regardless of when requested — including within the no-cancellation window
5. Payment Terms
- Fees displayed are inclusive of applicable taxes unless stated otherwise
- Compliance Support, Advisory, and Audit fees are agreed directly
- Payments processed through Razorpay (RBI-authorised Payment Aggregator). FIO Foundation does not collect or store payment credentials
- All prices in Indian Rupees (INR)
- GST invoices issued where GSTN is provided at booking. Invoices cannot be amended retroactively
- If payment was deducted but no confirmation received, contact connect@fiofoundation.org with the transaction reference number
- Fees may be revised; the fee applicable to your booking is the one displayed and confirmed at the time of registration
6. Cancellation and Refund Policy
6.1 Cancellation by Participant — Bootcamps and Live Training
More than 10 days before the event: 100% full refund. Processed within 7 working days of confirmation.
7 to 10 days before the event (inclusive): No refund. Participant substitution available (see Section 4.4).
Less than 7 days before the event: No refund. Fee fully forfeited. Substitution available up to 48 hours before.
No-show: No refund. No substitution credit.
All cancellation requests must be in writing — email connect@fiofoundation.org or WhatsApp +91 99617 71711 — with booking reference, registered name, and programme name. Verbal cancellations are not accepted. Refunds credited to the original payment method.
6.2 Cancellation by Participant — Online Courses
Once access has been granted, no refund will be issued. For technical access issues, contact connect@fiofoundation.org within 48 hours of enrolment.
6.3 Cancellation or Rescheduling by FIO Foundation
We may cancel, postpone, reschedule, or change the venue of any event due to insufficient registrations, force majeure, venue or trainer unavailability, or other operational reasons.
Option A — Full Refund: 100% refund within 7 working days of cancellation notice.
Option B — Transfer: Transfer to next available batch or alternate location (Kochi, Kozhikode, Thiruvananthapuram), subject to availability. If the new fee is higher, you pay only the difference; if equal or lower, no additional charge applies and no refund of any difference is issued.
FIO Foundation's liability is strictly limited to the options above. We are not liable for consequential losses such as travel, accommodation, or loss of earnings.
6.4 Cancellation of Compliance Support, Advisory, and Audit Engagements
Governed by the specific written agreement or email confirmation. In the absence of a specific agreement, at least 14 days' notice is required to terminate, and fees for completed work are non-refundable.
7. Certificates
- Participants completing a Bootcamp or live training receive a Certificate of Participation
- POSH Certification Programme completion yields a Certificate of Completion
- Certificates are issued in the name registered at booking; reissue for registrant errors may attract a fee
- Certificates evidence educational participation; they are not government licences or statutory qualifications unless stated
- Issued digitally via email; physical certificates at FIO Foundation's discretion
- Significant absence may result in no Certificate at FIO Foundation's reasonable discretion
- Replacement requests for lost digital certificates accepted within 12 months
8. Training Materials and Deliverables
8.1 Training Materials
- Sharing of training materials is at FIO Foundation's sole discretion and varies by programme
- Where shared, materials are for personal professional use and may not be reproduced, distributed, used to train third parties, published, or sold
- All materials remain FIO Foundation's intellectual property
- Compliance materials (policy templates, IC formats, agenda templates) may be adapted for the recipient organisation's internal use only
8.2 Compliance Support and Audit Deliverables
- Deliverables — Gap Analysis Reports, Roadmaps, policy drafts, IC formation documents, meeting records — are for the exclusive use of the client organisation
- May not be shared with third parties or published without prior written consent
- FIO Foundation retains IP in frameworks, methodologies, templates, and formats; the client receives a licence for internal compliance use only
9. Photography, Recording, and Media Consent
- FIO Foundation may photograph or record sessions for documentation, social media, marketing, and promotional use
- Consent is sought before recording; participants who opt out must inform the FIO representative beforehand
- Consent covers publication on Instagram, LinkedIn, YouTube, and the Website unless specified otherwise
- Consent may be withdrawn for future use by writing to connect@fiofoundation.org; reasonable efforts will be made for already-published content
- Participants must not record, photograph, or livestream sessions without prior written consent
- Third-party venue or co-host policies may also apply
- FIO Foundation will never photograph, record, or share any content from POSH Advisory sessions involving active complaints or inquiry proceedings.
10. Intellectual Property
- All Website content is the exclusive IP of FIO Foundation or its licensors, protected under the Copyright Act, 1957 and international IP laws
- The FIO Foundation name, logo, and tagline ("Future Is Ours") may not be used without prior written consent
- Blog content may be referenced for non-commercial informational purposes with attribution and a link to fiofoundation.org
- No content may be reproduced for commercial purposes or used to create competing products without permission
- Unauthorised use may result in legal action under Indian and international law
11. Important Disclaimer — Not Legal Advice or Legal Representation
This is one of the most important clauses in these Terms.
- FIO Foundation is a training and compliance awareness organisation. We are NOT a law firm and do NOT provide legal representation, opinions, or advice
- All services — training, bootcamps, certification, compliance support, advisory, audits, blog and helpline guidance — are for educational awareness, practical compliance guidance, and capacity-building only
- Completion of any programme or engagement does NOT constitute legal representation, guarantee compliance, substitute for legal counsel, or confer any statutory qualification or accreditation
- POSH Advisory limitation: Provides procedural guidance to ICs and organisations. We do not represent or act for any complainant or respondent and do not appear in inquiries as counsel or representative
- POSH Audit limitation: A compliance awareness assessment, not a statutory or legal audit. The Gap Analysis Report is not a legal certificate of compliance, clearance, or clean chit
Organisations are strongly advised to seek independent legal counsel for formal legal opinions, representation in complaints/inquiries, and interpretation of the Act in specific disputes.
FIO Foundation does not accept liability for any loss, penalty, regulatory action, or adverse finding arising from reliance on our training, advisory, audit findings, or templates as a substitute for legal counsel.
12. Third-Party Trainers, Venues, and Co-Hosts
- Authorised partner trainers may co-facilitate or deliver programmes; FIO Foundation remains responsible for curriculum and quality
- Programmes may be hosted at third-party venues; FIO Foundation is not responsible for venue conditions beyond reasonable control
- Co-host arrangements may include additional terms communicated in advance
- Disputes arising from third-party venue or co-host conduct beyond FIO Foundation's reasonable control are not grounds for refund unless FIO Foundation determines otherwise
- All bookings and payments must be made through fiofoundation.org or official channels
13. Confidentiality
- For Advisory and Audit engagements, all client information — including complaint details, parties, proceedings, and internal documents — is treated as strictly confidential
- Information will not be disclosed to any third party except as required by law or court order
- Clients must ensure their sharing of information with us does not itself violate any confidentiality obligation
- Confidentiality applies to FIO Foundation's team, partner trainers, and any engaged individual
- FIO Foundation will never record, photograph, publish, or share any details of an advisory session involving an active complaint or inquiry
14. Participant and Client Conduct
All participants and clients agree to:
- Conduct themselves professionally and respectfully
- Refrain from disruptive, offensive, discriminatory, or harassing behaviour — including conduct that would itself violate the POSH Act, 2013
- Not record, photograph, or share session content without prior written consent
- Provide accurate, honest, and complete information for compliance, advisory, or audit engagements
- Not misuse our services, content, or deliverables for any unlawful or commercially exploitative purpose
We reserve the right to withdraw from any engagement or remove any participant for misconduct. Where removed for misconduct, no refund is issued.
15. Acceptable Use of the Website
You agree that you will NOT use this Website to:
- Violate any applicable law or regulation
- Submit false, misleading, or fraudulent information
- Attempt unauthorised access to any part of the Website or systems
- Scrape, crawl, or extract data using automated tools
- Transmit any virus, malware, or harmful code
- Impersonate FIO Foundation, its team, or any other person or organisation
- Damage, overburden, or impair Website functionality
- Send spam or unsolicited commercial communications via our forms
We reserve the right to block access for any user who violates these standards.
16. Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total liability — in contract, tort, negligence, or otherwise — shall not exceed the total fees paid by the user, participant, or client for the specific programme or service giving rise to the claim
- We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of business, revenue, data, goodwill, or regulatory penalties
- Not liable for delay or failure caused by acts of God, natural disasters, pandemic, government orders, internet or power failures, or other force majeure events
- We do not warrant the Website will be uninterrupted, error-free, or free from harmful components. Use is at your own risk
- Nothing excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be excluded under Indian law
17. Links to Third-Party Websites and Services
This Website contains links to third-party services including WhatsApp, Razorpay, LinkedIn, Instagram, and YouTube. FIO Foundation does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party website. Review the terms and privacy policies of any third-party platform before sharing your personal information.
18. Privacy
Your use of this Website and our services is also governed by our Privacy Policy, which is incorporated into and forms part of these Terms. By accepting these Terms, you also accept the Privacy Policy.
19. Modifications to These Terms
FIO Foundation reserves the right to revise these Terms at any time. Updated Terms will be published on this Website with a revised date. Your continued use of the Website or our services after revised Terms are posted constitutes acceptance.
20. Governing Law and Dispute Resolution
- These Terms are governed by the laws of India
- Disputes shall first be attempted through good-faith negotiation
- If unresolved within 30 days of written notice, parties may refer to mediation
- If mediation fails, the courts of Malappuram, Kerala, India shall have exclusive jurisdiction
- For consumers outside India, nothing limits rights under your local consumer protection laws
21. Severability and Entire Agreement
If any provision is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FIO Foundation with respect to your use of this Website and our services.
